This clause and policy are to state that the employee agrees to submit to drug and alcohol testing and to abide by the rules of not attending work under the influence, and how the tests will be carried out.
Employers have the right to introduce drug testing to the workplace, but you must first seek agreement to undertake the test. The best way to do this is to add a drug testing policy to your policy manual and introduce the drug testing policy clause to your employment agreements.
Drug testing is a compliant activity, but you must be clear about when and how the testing is to be carried out in order to remain compliant.
